Disney's Right of First Refusal (ROFR)

 

What is Disney's Right of First Refusal on all contracts?

Once an offer is accepted, all contracts are sent to the Disney review board. They will look at the terms of the contract to determine if the seller has accepted a "Fair Market Value" price for the ownership. If they determine that the offer was "under fair market value", Disney will buy it back themselves and not allow the buyer to have it. They do this to protect the value of ownerships. If it is deemed a "fair market value" offer, then Disney will approve the sale and let the buyer become the new owner.

As a Buyer, you may not like this now but you will when it is time for you to sell. The purpose of Disney's ROFR is to control the value of their property so that it remains in step with current values. When there is an accepted offer and a signed contract with a good faith deposit in escrow with a licensed and bonded title company, we immediately forward all contracts to the Disney Review Board. Disney will do an analysis of the terms of the contract and decide if they wish to step in as the Buyer. The criteria Disney uses for ROFR is not public information but one important factor for exercising the ROFR would be if Disney feels the selling price, including who pays closing costs and maintenance and taxes, is below the target price they have established. Don't worry, we can council you on current market conditions. If Disney exercises their ROFR and steps in as the Buyer, you can transfer your deposit to another quality DVC ownership that we will find for you or your deposit can be refunded in full at your request.
